Snapper Equipment Terms of Service for customers using https://snapperequipment.com.au/

Agreement: These Terms of Service ("Terms") govern your use of the Snapper Equipment website, the quotation system, and the purchase of any products from us.
Acceptance: By accessing or using any part of the site, submitting a "Get Delivered Price" request, or accepting a final quote, you agree to be bound by these Terms.
Governing Law: These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Commonwealth of Australia, including the Australian Consumer Law (ACL).

The "Get Delivered Price" process replaces the standard e-commerce contract formation.

Quote Request (Non-Binding): Submitting a "Get Delivered Price" request via the website constitutes a non-binding request for an offer. This action does not form a contract, and no payment is taken at this stage.
Quote as Offer: The subsequent Delivered Price Quote sent by Snapper Equipment via email serves as our formal offer to sell the specified product(s) at the specified total price (including product and freight costs).
Contract Formation: A legally binding contract for the sale and purchase of the goods is formed only when the Customer explicitly accepts the quote and successfully completes the full payment of the total amount specified in the quote.
Quote Validity: All quotes are valid for the period specified in the quotation document (30 days) unless otherwise stated. After this period, the quote expires, and a new quote must be requested, which may reflect price or freight changes.

Description Accuracy: We strive for absolute accuracy in product descriptions, dimensions, and coupler specifications. However, due to the industry and occasional supplier changes, small variations may occur.
Customer Specifications: The Customer is solely responsible for verifying the accuracy and suitability of all specifications provided to Snapper Equipment for custom-built or modified attachments (e.g., pin sizes, machine model, compliance requirements).
Custom Order Risk: For items manufactured or customised to the Customer's specification, the Customer bears the risk if the specifications provided were incorrect. Such items are non-refundable for change of mind (refer to the Refund Policy).

Final Price: The final, binding price is the total amount specified in the accepted Delivered Price Quote.
Taxes: All prices quoted are inclusive of Australian Goods and Services Tax (GST) unless otherwise stated in the quote.
Currency: All prices and payments are in Australian Dollars (AUD).
Payment Security: All payments are processed through Shopify’s approved third-party payment gateways. Snapper Equipment does not store your credit card details.

Freight Responsibility (Paid): The Customer is responsible for reviewing and paying the separate heavy freight cost as determined in the final quote.
Unloading Obligation: The Customer accepts full responsibility for the safe and legal unloading of all heavy freight items at the delivery location. This includes ensuring the availability of appropriate lifting equipment (e.g., forklift) and qualified personnel.
Delivery Delays: Delivery dates provided are estimates only. Snapper Equipment is not liable for delays caused by the freight carrier, customs, or other events beyond our reasonable control.

Statutory Guarantees (ACL): Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Exclusions: To the maximum extent permitted by law, Snapper Equipment's liability for any product failure is limited to the remedies provided under the ACL (repair, replacement, or refund of the purchase price).
Limitation of Liability: Snapper Equipment is not liable for any consequential or indirect loss or damage (including loss of profits, downtime, or damage to other equipment) arising from the use or inability to use the purchased equipment. The Customer is responsible for the proper installation, maintenance, and safe operation of the equipment.

This process is governed by our separate Refund Policy (which forms part of these Terms).
All refund requests, whether for change of mind or faulty goods, must be initiated by contacting sales@snapperequipment.com.au.

All content on this site, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Snapper Equipment or its content suppliers and is protected by Australian and international copyright laws.
The Customer acknowledges that all intellectual property rights in any custom designs or modifications developed by Snapper Equipment for the Customer remain the property of Snapper Equipment unless otherwise agreed in writing.

Your submission of personal information through the store is governed by our separate Privacy Policy (available on this website).

Termination by Snapper Equipment: We reserve the right to refuse service, cancel orders, or terminate accounts at our sole discretion, particularly if we believe a customer’s conduct violates these Terms or is harmful to the business.
Variation: We reserve the right to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website after the posting of any changes constitutes acceptance of those changes.
